Previous issue date: 2006 / This study intended to examine a specific aspect concerning the correlation between the maxim of proportionality — in it’s double dimension of “prohibition of excess” an “prohibition of insufficiency” — and the effectiveness of the fundamental right of effective judicial protection. After brief considerations on the contemporary notion of fundamental rights in the brazilian democratic state and on the dynamic of their normative effectivation, was given emphasis in a theoretical approach to the applicability of the refered maxim and of it’s relying standard of normativ balancing regarding the solution of the fundamental rights’ collisions taken upon the judicial promotion of the suitability of civil law procedures to the goals of the substancial right. / O presente estudo objetivou examinar um aspecto preciso do correlacionamento existente entre a máxima da proporcionalidade, compreendida na sua dupla dimensão de proibição de excesso e de insuficiência, e a eficácia do direito fundamental à tutela jurisdicional efetiva. Foi dada ênfase ‑ após breves incursões acerca da noção contemporânea de direitos fundamentais na estatalidade jurídico democrática brasileira e da dinâmica de sua realização normativa – à aplicabilidade da aludida máxima e do critério da ponderação normativa a ela subjacente, sob prisma eminentemente teórico, no equacionamento, das colisões de direitos fundamentais verificadas no âmbito da conformação judicial da técnica processual civil aos designios do direito material.
