Previous issue date: 2013 / The adhibition of chaos theory to law can be seen from the consideration of the legal system as a complex, dynamic, nonlinear, aperiodic and sensitive system to the initial terms. The adoption of such a theory allows transdisciplinary work in the legal system as an open system, giving scientificity to the uncertainty notion and away the classic perspective of certainty and completeness. The human being dignity protection, as a value and fundamental principle, it matters in the necessary overcoming of normative validity only in formal aspect, because it implies the consideration of the case, that together with all others values and fundamental principles giving direction to normative formation for the case from all system rules, gives proper hermeneutic appreciation. Each rule that radiate from the legal system contain itself in its evaluative totality, giving up the hermeneutic through the topicsystematic interpretation. The lack of law certainty is verified from language polysemy. The complexity and uncertainty even related to the legal text is verified from democratic process of electing legislators. Due to the transdisciplinary appreciation of Law Science and from the openness and complexity of legal system becomes unnecessary barriers between sciences and even within the legal science. As a fundamental value radiates throughout legal system, it gives direction and it gives unity, there is no motivation to maintain dichotomy Public Law and Private Law. Applying Chaos Theory to Law provides the link between the real world and the entire law. / A aplicação da Teoria do Caos ao Direito se verifica possível a partir da consideração do sistema jurídico como um sistema complexo, dinâmico, não linear, aperiódico e sensível às condições iniciais. A adoção de tal teoria permite o trabalho transdisciplinar do sistema jurídico como um sistema aberto, dando cientificidade à noção de incerteza e afastando a perspectiva clássica de certeza e completude. A proteção da dignidade da pessoa humana, como valor e princípio fundamental, importa na necessária superação da validade normativa apenas no aspecto formal, pois implica na consideração do caso concreto, que em conjunto com todos os outros valores e princípios fundamentais orientando a formação normativa para o caso a partir de todas as regras do sistema, dá a apreciação hermenêutica adequada. Cada norma que emana do sistema jurídico o contém em sua totalidade valorativa, dando-se a hermenêutica através da interpretação tópico-sistemática. A falta de certeza da lei se verifica a partir da polissemia da linguagem. A complexidade e a incerteza mesmo em relação ao texto legal se verificam a partir do processo democrático de eleição dos legisladores. Em virtude da apreciação transdisciplinar da Ciência do Direito e da abertura e complexidade do sistema jurídico tornam-se desnecessárias as barreiras entre ciências e mesmo dentro da ciência jurídica. Como os valores fundamentais se irradiam por todo o sistema jurídico, o orientam e dão unidade, não há motivo para se manter a dicotomia Direito Público e Direito Privado. Aplicar-se a Teoria do Caos ao Direito proporciona a união entre o mundo real e o do Direito como um todo.
