Previous issue date: 2013 / This paper studies three fundamental themes of international civil procedure. For this, the first part sets up the theoretical framework of the research, assuming that the science of law, as cultivated at present, is a practical discipline, and purely positive models are insufficient for proper interpretation and application of the law. It follows by selecting the model of discursive reasoning of moral judgments, connected it with the alexyan theory of legal reasoning, in the sense that reality cuts the speech, but the speech conforms reality. This is connected with the empirical argument, which is associated with increased frequency of international interactions. In the second part, we study the fundamental issues related to the handling of legal positions qualified by the note of internationality. First, in relation to cases of decentralized application of uniform standards, we study the issue of normative hierarchy between domestic and international law. Second, for the cases in which there is multiconected relationships, we studied the use of mechanisms of international civil procedure in weak sense, that is, mechanisms related primarily to the definition of the 'competent' state jurisdiction in relation to other states, as well as the international movement of judicial acts. Third, as regards properly international relations and the cases in which uniform standard (=international) appy, we look at the use of mechanisms of international civil procedure in strong sense, that is, management of processes regulated in international instruments and developed in centralized spaces (= international court). / Este trabalho estuda três temas fundamentais do processo civil internacional. Para isso, na primeira parte, estabelece-se a estrutura teórica da pesquisa, admitindo que a ciência do direito, como cultivada na atualidade, é disciplina prática, e que modelos puramente positivos são insuficientes para adequada interpretação e aplicação do direito. Segue-se selecionando o modelo discursivo de fundamentação de juízos morais, conectado-o com a teoria alexyana da argumentação jurídica, no sentido de que a realidade recorta o discurso, mas o discurso conforma a realidade. Isso é ligado com o argumento empírico, que está associado ao incremento de frequência das interações internacionais. Na segunda parte, estudam-se temas fundamentais relativos ao tratamento das posições jurídicas qualificadas pela nota da internacionalidade. Primeiro, relativamente aos casos de aplicação descentralizada de norma uniforme, estudamos o tema da hierarquia entre a normativa interna e internacional. Segundo, para os casos em que há multiconexão na relação material, estudamos o uso de mecanismos do processo civil internacional em senso fraco, isto é, mecanismos conexos, essencialmente, com a definição da jurisdição estatal ‘competente’ relativamente a outros Estados, bem como à circulação internacional de atos jurisdicionais. Terceiro, no que toca às relações propriamente internacionais e aos casos em que incidente norma uniforme (=internacional), olhamos para o uso de mecanismos do processo civil internacional em senso forte, isto é, manejo de processos regulados em instrumentos internacionais e desenvolvidos em espaços centralizados (=juízo internacional).
