Previous issue date: 2013 / This thesis has, as an objective, to discuss the access to courts – right of action – from the penal procedure perspective – and to pursuit the claim as the propelling element of jurisdiction. From this first premise, it is necessary to point out the need to abandon the General Theory of Procedural Law and the need to reconstruct the complex prosecuting and defending actions from a different perspective, analyzing the theories of action and their requirements, the procedure, the object of the procedure, and proposing the modifications of the judicial institutes from this analysis. With this proposal, we find, amongst other things, that the right of action is manifested in the offering of charges or the dismissal of them, since what it authorizes it is the formulation of the punitive claim. / Esta tese tem por objetivo discutir o direito de acesso aos Tribunais – direito de ação – valendo-se da realidade própria do Processo Penal – e pugnar pela pretensão como o elemento propulsor da jurisdição. Dessa premissa inicial, faz-se necessário pontuar a necessidade de abandono da Teoria Geral do Processo e reconstruir os complexos atos de acusar e de defender desde uma outra roupagem, passando pelo enfrentamento das teorias da ação e suas condições, da lide, do objeto do processo e propondo a releitura de institutos jurídicos à luz da nova realidade. Com a proposta, entendemos, dentre outros, que o direito de ação se manifesta, quer com o oferecimento de acusação, quer com o pedido de arquivamento, já que o que autoriza é a dedução de uma pretensão.
