Previous issue date: 2014 / The analysis object of this scientific research is the material basis of responsibility in criminal law. The problem of the material basis of responsibility presupposes the human freedom and its unfolding ethical. The problem and object of this scientific research is the analyze of what measure is possible to build an onto-anthropological fundament, pos-finalist and not functionalist, for the responsibility in criminal law. The theoretical foundation that permits the verification of the onto-anthropological hypothesis is Heidegger ontology and Faria Costa and D'Avila onto- anthropological theory. The creation of an onto-anthropological fundament, pos-finalist and not functionalist, for the responsibility in criminal law presupposes the delimitation of the concept of human being and freedom that is capable to support the idea of legal censure that inflict in the individual man for the committed crime. This task is done with the theoretical foundation indicated to verify the hypothesis in this work. / O objeto de análise da presente pesquisa científica é o fundamento material da culpabilidade jurídico-penal. O problema do fundamento material da culpabilidade jurídico-penal pressupõe a questão da liberdade humana e de seu desdobramento ético-relacional. O objetivo-problema desta pesquisa científica é analisar em que medida é possível a construção de um fundamento onto-antropológico, pós-finalista não funcionalista, para a culpabilidade jurídico-penal. A base teórica com a qual se pretende verificar a hipótese de que é possível a construção de um fundamento onto-antropológico, pós-finalista não funcionalista, para a culpabilidade jurídico-penal, é a ontologia fundamental de Heidegger e a fundamentação onto-antropológica do direito penal de Faria Costa e D`Avila. A construção de um fundamento onto-antropológico, pós-finalista não funcionalista, para a culpabilidade jurídico-penal pressupõe a delimitação de um conceito de homem e de liberdade que seja capaz de suportar uma noção de censura jurídico-penal que atinge o homem individual concreto pelo ilícito-típico concreto cometido. Essa tarefa é realizada pela base teórica proposta para a verificação da hipótese deste trabalho.
