Previous issue date: 2014 / This research aims to discuss the Brazilian Military Criminal Law based in the theoretical legitimation attempts of the Criminal Law. The essential question is about the legitimacy of a military criminal law based on hierarchy and discipline. From the original question, we have brought to light the contemporary theories that attempt to justify the criminal law, namely the theories related to criminal functionalism (moderate - Claus Roxin, and radical - Günther Jakobs ) and the onto-anthropological theory of José Francisco de Faria Costa. In the Functionalist theories the object is in the consequences, there is a projection into the future. In the onto-anthropological theory, the man is placed as gravitational center of the building on the right. It assumes the idea that the law isn’t a technique, the law sets a manifestation of our deeper way of being with others, conforms to both limit and foundation of "I" with the "other". It’s analysed also about the hierarchy and discipline as fundamental precepts of the Armed Forces. In the second part, it penetrates to the military criminal offense, attempting to identify their material contours. It is possible to assert a lack of material density in the current definition of military Illicit in the Brazilian criminal law, which leads to serious problems of legitimacy of the criminal law. In the investigation it was possible to sketch at least two criteria that could serve as a starting point to the military justice system: (a) the military nature of the legal interest; (b) the quality of the author who infringes their military duties as a member of Armed Force. / A presente investigação tem por finalidade discorrer sobre o Direito Penal Militar brasileiro à luz das tentativas teóricas de fundamentação do Direito Penal. O questionamento fundamental trata sobre a (i)legitimidade de um direito penal militar fundado na hierarquia e disciplina. A partir da pergunta inicial, trouxemos a lume as teorias contemporâneas que intentam fundamentar o direito penal, a saber: as teorias ligadas ao funcionalismo penal (moderada de Claus Roxin; e radical de Günther Jakobs) e a teoria onto-antropológica de José Francisco de Faria Costa. Com o estudo das referidas teorias, foi possível desvelar a racionalidade que as guiam. Nas teorias de cunho funcionalista o mote está nas consequências, há uma projeção para o futuro. Já na teoria onto-antopológica, o homem é colocado como o centro gravitacional da construção do direito. Assume-se a ideia que o direito não é uma mera técnica, pelo contrário, o direito configura uma manifestação do nosso mais profundo modo-de-ser com os outros, é dizer, conforma-se simultaneamente como limite e fundamento do “eu” com o “outro”.Discorre-se, ainda, sobre a hierarquia e disciplina enquanto preceitos fundamentais das Forças Armadas, embora sejam necessários outros referenciais para colocá-los como preceitos legitimadores do próprio direito penal militar. Na segunda parte do trabalho, adentra-se ao ilícito penal militar, intentando-se identificar seus contornos materiais. É possível afirmar uma falta de densidade material na definição atual de crime militar no direito penal brasileiro, o que leva a sérios problemas de legitimidade desse setor do direito penal. Em vias de investigação, foi possível esboçar ao menos dois critérios que poderiam servir de ponto de partida ao sistema penal militar: (a) a natureza militar do bem jurídico; (b) a qualidade do autor que infringe seus deveres militares enquanto membro das Forças Armadas.
