La presente tesis tiene como objetivo general, identificar la brecha entre los plazos y
el costo real con la normatividad para los cinco aspectos vinculados a la facilidad para hacer
negocios acorde a la metodología del Banco Mundial, en la ciudad de Paita, Perú. El
propósito de la investigación es descriptivo con un enfoque cualitativo, la cual se desarrolla
en recopilar información de expertos con diferentes perfiles como gerente general, abogados
especializados, contratista, notario especialista, funcionarios de registros públicos, municipal,
empresa de distribución eléctrica, OSINERGMIN y juzgado; sobre dos variables principales
que son: el tiempo y costo de la tramitología para emprender y poner en operación un negocio
en la ciudad de Paita, Piura. El instrumento que se utiliza son las entrevistas en profundidad,
basados en cuestionarios estandarizados según la metodología del Doing Business del Banco
Mundial, las cuales fueron aplicadas a 17 expertos que voluntariamente contribuyeron con el
estudio.
A partir de esto, los resultados obtenidos establecen la existencia de brechas entre lo
que sucede en la práctica y lo establecido en las normativas vigentes, identificando como
principal brecha la que existe en la variable tiempo, del indicador cumplimiento de contrato,
llegando a triplicar el número de días en perjuicio a la solución de disputas comerciales. Del
mismo modo, se encuentra una brecha en la variable costos del indicador obtención de
permisos de construcción, llegando a exceder en la práctica lo establecido en la normativa.
Asimismo, los resultados identificaron que la ciudad de Paita tiene un mayor grado de
facilidad de hacer negocios con respecto a Lima, debido a una mejor posición en el indicador
registro de propiedad. Sin embargo, acusa un menor grado de facilidad con respecto a
ciudades del extranjero, debido a que las ciudades foráneas analizadas en este estudio
obtienen una mejor posición en todos los indicadores de la metodología / The present thesis aims to identify the gap between the deadlines and the real cost
with the regulations for the five aspects related to the ease of Doing Business according to the
methodology of the World Bank, in the city of Paita, Peru. The purpose of the research is
descriptive with a qualitative approach, which is developed in gathering information from
experts with different profiles such as general manager, specialized lawyers, contractor,
specialist notary, public records, municipal, electricity distribution company, OSINERGMIN
and court; On two main variables that are: the time and cost of the pathology to start and start
a business in the city of Paita, Piura. The instrument used is the in-depth interviews, based on
standardized questionnaires according to the World Bank's Doing Business methodology,
which were applied to 17 experts who voluntarily contributed to the study.
From this, the obtained results establish the existence of gaps between what happens
in practice and what is established in the current regulations, identifying as the main gap the
one that exists in the time variable, of the contractual indicator, reaching a tripling of Number
of days to the detriment of the settlement of commercial disputes. Similarly, there is a gap in
the variable costs of the indicator obtaining construction permits, reaching to exceed in
practice what is established in the regulations.
Likewise, the results identified that the city of Paita has a greater degree of ease of
Doing Business with respect to Lima, due to a better position in the property registry
indicator. However, it shows a lesser degree of ease with respect to foreign cities, because the
foreign cities analyzed in this study obtain a better position in all the indicators of the
