El presente artículo tiene como propósito analizar la convencionalidad de la medida de colocar carteles transinclusivos en los baños del aeropuerto internacional Jorge Chávez. En ese sentido, el artículo está compuesto por cuatro subcapítulos: en primer lugar, se analizará la situación reciente de la comunidad trans en América Latina, haciendo énfasis en la violencia ejercida hacia esta comunidad y el paulatino reconocimiento de derechos en algunos países como Argentina y Chile; en segundo lugar, se desarrollará el contenido constitucionalmente protegido de los derechos al libre desarrollo de la personalidad y la identidad de género, para ello se recurriá al análisis doctrinario y jurisprudencial, tanto nacional como internacional; en tercer lugar, se cuestionará la vinculatoriedad de las Opiniones Consultivas de la Corte Interamericana de Derechos Humanos y se desarrollará el contenido de la Opinión Consultiva 24/17; finalmente, se realizará el control de convencionalidad a la medida utilizando como sustento lo desarrollado en los subcapítulos anteriores. Como principal conclusión afirmamos que colocar carteles transincluyentes en los exteriores de los baños del aeropuerto es concordante a lo desarrollado por la Corte IDH en relación a la defensa de los derechos de la comunidad trans y que, además, es la medida más idónea para tal protección. / The purpose of this article is to analyze the conventionality of the measure of placing trans-inclusive posters in the bathrooms of the Jorge Chávez International Airport. In this sense, the article is composed of four subchapters: first, the recent situation of the trans community in Latin America will be analyzed, emphasizing the violence exercised against this community and the gradual recognition of rights in some countries such as Argentina and Chile; secondly, the constitutionally protected content of the rights to the free development of personality and gender identity will be developed, for which doctrinal and jurisprudential analysis, both national and international, will be used; thirdly, the binding nature of the Advisory Opinions of the Inter-American Court of Human Rights will be questioned and the content of Advisory Opinion 24/17 will be developed; Finally, the control of conventionality will be carried out to the measure using as a basis what has been developed in the previous subchapters. As a main conclusion, we affirm that placing trans-inclusive posters outside the airport bathrooms is consistent with what has been developed by the Inter-American Court of Human Rights in relation to the defense of the rights of the trans community and that, in addition, it is the most suitable measure for such protection. / Trabajo académico
