The U.S. Trade Policy for the Intellectual Property Rights of Information Industry toward the Two Sides of the Taiwan Strait (1976~1996) / 美國對海峽兩岸資訊產業智慧財產權貿易政策之研究(1976∼1996)

碩士 / 淡江大學 / 美國研究所 / 84 / This thesis explores the U.S. trade policy during 1976 and 1996
in which persuades the governments of the two sides of the
Taiwan Strait of protecting the intellectual property rights
(IPR) of the U.S. information industry. The main purpose of the
thesis goes to explain that the U.S. conducts a coercive trade
policy unilaterally, bilaterally and through its claim in
establsing an effective and plurilateral IPR institution to
retain its market and competitiveness of the industry
domestically and abroad. In the perspective both Taiwan and
China can''t but cooperate with the U.S. so that their trade
losses by possible sanctions and breakups of the trade ties
are avoided.>>Directed by the case study method and derived from
concepts of theories of public goods and international
cooperation discussed in Chap. 2, hypotheses are tested in
specifying the U.S. policy. For one point, the policy as being
depicted in the hypotheses and explained further in Chap. 3 is
to conform the trade partners with the U.S. IPR legal
principles, most powerfully by executive exercises of the
authorization from Section 337 of the Tariff Act of 1930 (as
amended), and the Special 301 clause of the Trade Act of 1988.
The U.S. Customs Service, the International Trade Commission,
and the Office of the U.S. Trade Representative are responsible
and responsive in that policy demand. With such retaliatory
powers in hand, the U.S. has achieved IPR enforcements in Taiwan
(Chap. 4) and negotiated with>good faith and results with China
(Chap. 5). The case studies of Taiwan and China accord with the
hypothetical and theoretic assumptions.>>At last but not the
least, the U.S. policies proceeded and flourished in Taiwan and
China are compared with the comparative method. Based on the
discussions in the thesis, this author also draws out future
developments of international cooperation in IPR protection for
information industry.
