碩士 / 國立海洋大學 / 海洋法律研究所 / 88 / The twentieth century has seen great advances in both the public international and private law concerning seaworthy norms of ships. It has been developed largely through conventions concluded by the UN, the IMO and the ILO etc aimed at increasing the safety of ships, protecting the marine environment from vessel—source pollution and improving standards of crewing, training and accommodation on board ships. These have been reflected in various regional conventions and protocols. Unforunately, many of these conventions are neither as widely ratified nor as effectively enforceed as is necessary to ensure achievement of their objective of securing safer and cleaner seas. This is attributable to the long-standing primacy accorded in enforcement matters to the jurisdiction of the State whose flag a vessel flies. Many of these do not stringently enforce even conventions to which they are parties. Attention has thus increasingly been paid in recent times to the role that can be played by the port State, that is to say the State whose port a vessel voluntarily enter, in enforcing the law and in monitoring observance of the international standards created by it. Many conventions now encourage port States to inspect for this purpose vessels entering their ports and to report any deficiences to the flag State Port State Control.
Recently, few subjects in shipping have received as much coverage as the International Safety Management(ISM)Code which become mandatory. Emphasizing on controlling the human factor, ISM Code is a systematic safe operational system whose purpose is to provide a strict international standard for the safe management and operation of ships for pollution prevention. The implementation of ISM Code will undoubtedly have an effect on some areas of the current maritime law(especially for seaworthy norms of ships).
