Power and Tactics in Negotiation: A Case Study of the Employment System Transformation at the Kaohsiung Harbor / 高雄港碼頭工人僱用改制談判中權力與戰術之研究

碩士 / 國立中正大學 / 勞工研究所 / 91 / This research has explored the power structure and tactics in the negotiation between Kaohsiung Port’s Stevedore Union (PSU) and Kaohsiung Harbor Bureau (KHB) during the transformation of employment system at the Kaohsiung Harbor. Original data for analysis were primarily collected from the KHB archives and supplemental data, from news coverage.
The port of Kaohsiung is Taiwan’s principal commercial port, as well as the gateway shipping cargo from and to Taiwan. In particular, it is the hub for transshipments throughout the Asia-Pacific region. In 1996, the government decided to privatize cargo handling operations. Stevedores, represented by the PSU, and the KHB engaged in a negotiating on the terms for employment termination. The negotiation process included ten sessions. Finally, they reached settlements that seemingly satisfied stevedores.
In terms of relative power between the PSU and the KHB, it was asymmetrical. The PSU adopted a variety of tactics to increase its power. It has found that in facing resistance from the KHB, the PSU consistently employed two tactics that were useful and crucially contributed to the dispute settlement in favor of stevedores'' goal. First, the PSU set a time limit that forced the KHB to make concessions on issues regarding severance pay and compensations. Second, the PSU invited the third party''s intervention to increase its power. The third party mainly included members of the parliament, who were elected from the district of Kaohsiung. They, under the consideration of maintaining their political support from stevedores, assisted the PSU to persuade the KHB and other relevant government agencies, such as the Ministry of Transportation and Communications. This tactic was quite effective, helping the PSU to achieve most of its stated goals.
This research has concluded that the weaker party in a negotiation can get the desirable outcome if they appropriately use the tactics that can convert resources to useful power. The PSU in the negotiation with the KHB was just the case.
