In many countries, there are certain exemptions set provided by their maritime laws, in order to encourage the development of shipping industry. Obviously shipping has been treated as a high-risk business. What common property insurance provides are limited risk covers in respect of damage to/loss of properties. However, the liabilities to third parties that ship owners are facing are usually higher then those arising from the loss of properties. Especially, in recent years, environmental issues become important and crucial to our daily life. Claims arising from pollution or damages to environment could cause ship owners serious financial problems. Therefore, the arrangement of insurance would mean to cover the unexpected claims that might cause the assured financial problems. P&I insurance provides unlimited cover for ship owners (except limited cover up to USD100 million for oil pollution claims). To the high-risk shipping business, such a protection is obviously very important to ship owners.
In consideration of the above problems that the ship owners might face while they are dealing with P&I claims, the thesis aims to work out the best way to protect ship owners'' interests, and at the same time not to prejudice P&I Club''s cover. In the meantime, by introducing the structure of P&I Clubs, this thesis provides ship owners/operators a guide to select proper P&I Clubs.
The thesis is divided into five chapters. Chapter 1, introduction contains the motivation, goal, research methods & process of this research. Chapter 2, explores structure & rules of P&I Club, as well as introduces the history and progress of P&I insurance. Chapter 3, coverage of P&I insurance, provides detailed P&I insurances’ coverage, limitation & exclusion of coverage etc. Chapter 4 deals with the issues arising from those practice in P&I claim handling and takes “collision” as an example to illustrate the problem, issues and questions that ship owners might face while dealing with P&I claims. Chapter 5 provides conclusions and certain suggestions.
