碩士 / 國立海洋大學 / 海洋法律研究所碩士在職專班 / 92 / For the sake of solving of the dilemma of going to sea and reconstruct fishery, Administration Yuan disposes of fishermen from Mainland China from fishing house on the sea to positing on the road on spring vacation of 2003，fully put into practice settlement on the land till 1 December of 2003. Though Administration Yuan tries to solve the difficulties, it still has space to improve and progress.November, 2002, Supervisory Yuan is aimed at epidemic diseases and humanistic problems to ask Administration Yuan to establish effective management system rapidly. The content is as follows: Administration Yuan has not issued the decrees and related laws which are about the management and arrangement of hiring fishermen from Mainland China. For example, fishing house on the sea doesn’t have effective management system, and until now the new management center on the land has not used results in the fishermen from Mainland China inhabit in simple and crude boats for a long time and it causes hygienic, epidemic and secure problems. It not only impairs scene but also influences national security.
1 February, 2002, the authority of Mainland China forbids fishermen from Mainland China working on Taiwan’s boats. Though it protects the fishermen from Mainland China, actually, it mars the working rights of the fishermen from Mainland China; meanwhile, it hampers the rights of fishship-owners in Taiwan.
Under the fact of fishery between Taiwan and Mainland China is mutual help and mutually beneficial, the authorities of Taiwan and Mainland China should draft the effective management system and cease disputes about sovereignty.This research will try to discuss the differences between theories and practices and offer personal suggestions to our government. Therefore, they can issue the decrees and related laws about hiring and managing fishermen from Mainland China.
