碩士 / 國立臺灣海洋大學 / 海洋法律研究所 / 92 / Taiwan’s maritime enforcement has always been controlled and implemented through the Ministries of Interior, Finance, National Defense and The Coast Guard Bureau with orders often coming from many different directions creating disorganization and ineffectiveness. This thesis will introduce the framework of the types of Taiwan’s maritime administrative inspections and the areas the enforcement implementation applies to, and will further discuss the legal quality of Taiwan’s current maritime administration inspections with the attempt to separate maritime administrative inspections into practical and legal actions according to suitable time and place, in order to protect people’s rights as to apply for the most beneficial legal help when disputes occur.
Upon the reform of the governmental units, the initial suggestion of establishing a department of maritime administrative affairs with the objective of unifying Taiwan’s maritime operations is offered. This thesis discusses the establishment of Taiwan’s maritime enforcement organization, its change over time, its reform, structure and the situation of the maritime administrative inspections in comparison with other international maritime law enforcement systems such as U.S.A.’s Coast Guard, Canada’s Coast Guard and Britain’s coastal patrol unit, etc., to better understand the good points and weak points of all and serve as a reference when revising our relevant regulations.
Finally, a special chapter is devoted to the discussion of the situation and development of the customs operational administration inspections on the sea and coast. Through reviewing the government’s current efforts in promoting private participation in various governmental operations by consignment, to discuss customs promotion of encouraging private entrepreneurs such as implement self managing container yards regulations, to transfer the cases from the present governmental supervision and control passing to private control, and to further discuss the lawfulness of the said situation and how people apply for suitable legal help when disputes occur to protect rights of all.
In addition, this thesis will introduce the implementation of the CSI Act in the U.S.A after the 9/11 terrorist attacks in order to protect the security of the country, and the influence of this on Taiwan, and how the Taiwan government and private businesses should deal with said.
