The subject of this research is “A study on the labor conditions and welfare protections in Seafarers Act of R.O.C.” This research analyzes the regulations of Seafarers Act and Labor Standards Law in Taiwan with literature views. It also compares labor conditions and welfare protections of Seafarers Act and Labor Standards Law in Taiwan with the ones in International Convention. For the purpose of revision in the future, this research provides a way to understand merits and flaws of labor conditions and welfare system of Seafarers Act in Taiwan.
The framework of this research divides into five chapters. Chapter One illustrates the motivation, methods and the definition of the realm of this research. Besides, it shows the rough contents of every chapter.
Chapter Two introduces the legislative history of Seafarers Act in Taiwan, and explains the reasons of legislation about labor conditions and welfare protections of Seafarers Act. For the sake of comparisons in the following chapters, Chapter Two also states the relating Regulations to comprehend the scheme of Seafarers Act.
Chapter Three shows the relationship of Seafarers Act and Labor Standards Law in Taiwan, and then contrasts the distinctions with each other. For example, the differences between the origins of two laws, and whether the Seafarers Act is suitable for Labor Standards Law, etc.
Chapter Four states the International Convention of International Labor Organization. It compares with the Seafarers Act in Taiwan, and discusses if the rights and interests of seafarers fit in with the tendency and patterns of International Convention. Finally, it provides ways of future revision.
Chapter Five concludes the contents in former chapters, and proposes that the relevant suggestions are beneficial for the oncoming labor conditions and welfare protections in Seafarers Act in Taiwan.
