A Study on Law Enforcement Strategy of Coast Guard Administration R.O.C / 行政院海岸巡防署執法策略運用之研究

Since The United Nations Convention on the Law of the Sea (herein after called UNCLOS) came into effect on November 16, 1994, all countries gradually emphasized on the development and management of marine resources, and coast countries have expanded jurisdiction of exclusive economic zone to 200 sea miles. Furthermore, with the economical development, all countries consider followings are important works of marine policy, namely, marine traffic safety, salvage, fishery resource management, non-biological resource development, marine environment conservation, anti-smuggling of gun and drug and illegal immigration, attacking pirates and counter terror.
Because Taiwan is surrounded by ocean, smugglers and illegal immigration groups move recklessly and frequently in smuggling and illegal immigration under the extortionate profits, which not only endanger public security and threaten the safety of public’s life, but could also bring in epidemic situations of bird flu, foot-and-mouth disease and SARS. Guns and drugs feature in small volume and high profits, thus, smugglers utilized the feature of containers’ random inspection and fishing vessels’ secret cabins to smuggle and endanger public security. Therefore, how to improve law practice in sea area and capacity of disaster rescue to maintain sail security and order on the sea, and how to ensure the stability and prosperity within the govern area are all important issues at this moment.
Of all coast countries in the world have established special institutions to maintain sea order, such as the US COAST GUARD and United
Kingdom Maritime and Coastguard Agency, in which the US Coast Guard
has the longest history of 214 years till now, and it keeps on improving and facilitates US becomes the powerful country on the sea in the world. The Special Police Seventh Headquarter of National Police Agency, Ministry of the Interior in Taiwan has been established in January 1990, it has a short history of 14 years. It is far behind the competition of international tendency and rights and interests; therefore, if we want to head-on and catch up with them, it is required to apply various policies appropriately to shorten development schedule.
This article will analyze, clarify and confirm the core of organizational law practice from the law practice and establishment history of Coast Guard Administration, and extend to infer the future focus of law practice by it from the example of the establishment of US Office of Homeland Security and the subsume of Coast Guard Administration to “Ministry of Interior and Homeland Security” by the Government reform. Furthermore, with the application of strategic method and through strategic planning and decision analysis theory of deductive and induction methods, it is expected to achieve present “Enforcing law practice in sea area and maintaining marine security” by Coast Guard Administration and the law practice strategy suggestion of “Homeland Security” in the future, and to improve the law practice capability in coast and sea effectively, strengthen duty execution and audit, attack marine crime effectively, create a safe and ordered sea area, and maintain the security of sea area in Taiwan.
