碩士 / 國立臺灣海洋大學 / 應用經濟研究所 / 93 / Since 2000 to 2002, there are eighteen Taiwanese distant water fishing vessels, which are operating in Pacific Ocean, were seized by Mainland Chinese fishermen on boat and were used a tools to sneak to United States or Canada. These illegal kidnapping events have put the property of boat owners and the life of Taiwanese fishermen in great danger. Since these cases had drawn the concern about breaking in the coast guard security system in USA, USA had filed the complaints directly to Taiwanese government and had demand the Taiwanese authority to revise the marine affair management scheme to prevent these crimes.
This thesis tries to analyze all of the eighteen cases that were recorded from 2000 to 2002, and to investigate the incentive to Mainland China’s fishermen, who tried to kidnap Taiwanese fishing vessels and use it as a tool to sneak to USA. A comprehensive comparison of the fishermen’s characteristics, the vessel type, the crime modes, the reaction of the Taiwanese captain and the follow up lawsuit procedure, which was taken by Taiwanese Fishery Administration Authorities are conducted in this thesis. In addition, an analysis about how the legal precedents in the court of USA impacts on Taiwanese fishermen is also discussed.
Since the fishery labor market in Taiwan is short of domestic fishermen, a great demand of Chinese cheap labor is shown in the fishery industry in Taiwan. This thesis found the kidnappers who had committed the crime are mostly come from Pingtan County, Fujian Province of China. Since the Chinese Government does not allow their fishermen work in Taiwan, the Taiwanese boat owners illegally hired those Chinese fishermen under a great risk to be kidnapped as a tool to sneak out of China. It is a challenge to Taiwanese Government to adopt an necessary control scheme to prevent the crime. In additional, the American political refugee policy is too liberal to prevent the incentive to Chinese fishermen to apply for residence in USA.
In order to solve the situation that already took place and prevent the situation from continuing taking place efficiently, I propose that our government should set up the single maritime affairs agency quickly to force the Taiwanese distant water fishing vessels to install the monitoring system in an all-round way and encourage the ship-owners to employ the fishermen separately and strengthen the communication with American on the issue that was derived from Mainland Chinese fishermen sneak to United States or Canada and strengthen to extradite the relevant fishermen involved in the case to our country and prevent Mainland Chinese fishermen from seizing the Taiwanese distant water fishing vessels used as a tool to sneak to United States efficiently.
