Chapter 1 motivation, thesis and research scopes
The incident of oil spill pollution of M/V Amorgos ship happened in 2001, have made us realized making assistance and salvage at sea efficiently and fast is more important than demanding compensation afterwards. As a result, the International Convention on Salvage, 1989, is the main issue needed to be introduced and discussed. Furthermore, the Lloyd’s Standard Form of Salvage Agreement would be introduced and discussed as well, and then the salvage of Maritime Law between the People's Republic of China and Taiwan would be compared with each other.
Chapter 2 Assistance and Salvage at sea
The chapter states the basic definition, character and the requirement of salvage. And then introduces the international Contract on Salvage.
Chapter 3 The International Convention on Salvage
This chapter introduces the history, background, importance of the International Convention on Salvage, 1989, furthermore discusses the connection of that to the Lloyd’s Standard Form of Salvage Agreement.
Chapter 4 Salvage in Taiwan
On the basis of salvage system on Maritime Law in Taiwan, the application of applicable law of salvage is stated and compared with the International Convention on Salvage, 1989. in this chapter.
Chapter 5 The comparison of People's Republic of China and Taiwan in the law of salvage
This chapter introduces the salvage of Maritime Law in the People's Republic of China. The salvage of Maritime Law in the People's Republic of China is almost the same as the International Convention on Salvage, 1989, therefore it is quite thorough and even better than Taiwan’s. As a result, it’s worthy to make reference to it.
Chapter 6 The conception of towage of ship, general average, and marine insurance
The salvage system usually relates to towage of ship, general average and marine insurance in the occurrence of wreckage. Therefore to state the connection between the conception of towage of ship, general average, and marine insurance and the salvage system is necessary.
Chapter 7 Conclusion
Summarizing the discussion and review above and commenting the defect of the legislation institution, this chapter provides the suggestion for the reference of revising the present salvage act.
