Studies on Relation of Charter Party and Bill of Lading / 傭船契約與載貨證券關係之研究

By the time now the shipment development has been separated into two major types from the point of view of the services market, which are Liner or Tramp. However, the liner shipment agreement is issued in Bill of Lading as the proof. But the Tramp shipment mostly is signed in Chaterparty. So these two documents are used as the two main agreements in the shipment services at the moment. But according to the regulation of the agreements in the Bill of Lading is not the shipment contract, it just the proving document of the shipment. On the other hand, the Chaterparty is also issued with the Bill of Lading. Therefore, disputes might happen between the Charterparty and the Bill of Lading. Another reason is due to the different natures of the two shipment document such as the Bill of Lading from signing and issuing to the end of the freight discharge. It might go through a lot of complex relationships and problems. For instant, what might be the ship owner’s advocating right to the Bill of Lading base on the Chaterparty? What might be the relationship between the trustee and the ship owner? Or what might be the effects of the Charterparty. when it is stamped with “as per Charterparty”. What might be the effects to signatories when there are different contents in different contracts? In this paper it might go into further discussion about the problems and complementary relationship between Bill of Lading and Charterparty.
