碩士 / 國立臺灣海洋大學 / 商船學系所 / 94 / The Ships are the most important equipment of the marine transportation management. The seafarers are the key point of the ship’s management and operation. The company couldn’t show his power, if the company only have a large of ships’ team , but be lack of the top seafarers. The Seafarers stay on the board all day long. They are different of the Labour who worked in the land, on the aspect of working and resting time, enjoying their spare tome, releasing their pressure. The contract should be terminated at maturity. In that situation, the seafarers don’t have any income. The contracts is their only protection. If the contents of the seafarers’ contract don’t conform to the regulations in our Laws of Seafarers and Labour. The rights of the Seafarers would be damage. Especially when they don’t have job in the land, will be more worried. Their families wouldn’t satisfied of their job.
The rights and welfare of seafarers affect on the attitude and mood of seafarers who work on the board. Because of that, I research our contract of Seafarers from our Laws of Seafarers and Labour. To analyze and to compare each rule of the contract from our Laws of Seafarers and Labour. Then to compare with the relative International Labour Laws, Consolidated Maritime Labour Convention and ITF-NCSU Collective Agreement 2005 for NCSU Crewmembers on FOC Ships, to conclude the resolutions. And find out, what place we need to improve, what place we have been good enough. To conclude the proper conclusions and advice. For increase seafarers’ desire to work on the board, promote our competition and bloom of marine, and protecting the rights of the seafarers.
