碩士 / 銘傳大學 / 社會科學院國家發展與兩岸關係碩士在職專班 / 95 / Since the martial law was lifted on the 15th of July, 1987, the situations of politics and society in our country have greatly changed. According to low, police as well as the police and coast guard agencies along the coast may perform security inspection to the crew and goods. The cases of smuggling firearms into our territory are rampant nowadays. This situation has seriously damaged the security of the nation and the order of society. In order to unify the authorities the establishing of the “Coast Guard Administration”has been formed.
The method of this research is a tentative study. The domain of the study is according to the article 4 of“Fishing Port Act”, including the first and the fourth categories of fishing ports and other anchoring locations indicated by the Council of Agriculture. With totally 230 fishing ports, this research studies the present situation of smuggling and the analyses of causes and characteristics of the illegalities as well as the construction of secret chambers and cabinets in the fishing boats. The scope also includes the trend of smuggling, such as delivery and replacement of objects, etc...
With the result of this study, The time for the smugglers to commit this type of crime is the periods during one or two months before Dragon Boat Festival, Mid-autumn Festival, Chinese Lunar New Year and the periods of high tide in the night and midday. Taipei County and I-Lang County both are the rocky coasts and are easy for offenders to hide behind. And that is one of the main causes of these illegalities. The deep docks are also convenient for ships to berth at all day long. All these situations give a loose rein to smugglers and stowaways. The special characteristic of eastern coast is considered as the worst locations by the smugglers and stowaways for illegalities. The shortage of equipment is one of the causes of inefficiency in security inspection and poor quality of a security check，lack of sufficient experiences of the coast guards is also one of the disadvantage of the security check.
The study offers some suggestions as the following：
1. The authorities should establish the regulation of managing shipmen from Mainland China and initiate a Center for shipmen from Mainland China so as to solve the problem of the lack of fishermen in our nation.
2. The effective strategy is to simplify the security inspection procedure in the fishing ports, promote the quality of security check staffs, intensify the education and training and improve the inspection equipments. Another strategy is to establish the information network to control the fishing vessels which enter and exit the fishing ports all over island by the record of customs.
3. This study indicates that 90％ of illegal cases in fishing ports were cleared based upon the accurate information. So it is necessary to expand the sources of intelligence and offer a special reward and encourage people by way of media to uncover the illegalities so as to prevent and eliminate the illegalities of smuggling and illegal entry.
