A Study on the Maritime Security In Response to Terrorist Activities: A Special Reference to the ISPS Code / 海事保安因應恐怖主義之研究--以ISPSCode為例

Shipping industry has long been an important role in the development of transportation. Under such circumstances, the maintenance of navigation security is a significant part within the maritime security. Moreover, it should not be overlooked the importance of port facilities security.
After 911 terrorist attack incident, it has been surmised that ships, whether it is a merchant ship or other kinds of vessels, might be used as a tool to take the offensive against ports or related facilities, which caused a great threat to the security of borderland. As such, states begin to re-institute and reassess their national defense policy. Furthermore, international cooperation on security issues has attracted attention from the members of the international society.
In terms of the issue on maritime security, International Maritime Organization (IMO) is one of the most important inter-governmental organizations and, since the 911 incident occurred, plays a steering role in drafting related international documents. International Ship and Port Facility Security Code (ISPS Code), Chapter XI-2 of the International Convention for the Safety of Life at Sea (SOLAS), is one of the documents mentioned above.
With regard to ships and ports facilities security, the ISPS Code provides a cooperation framework for international community to work on. According to the stipulations of the ISPS Code, not only should a ship prepare and comply security and safety examination documents, but also a port should conform to its assessment and security plan.
For the reason that some of the regulations concerning maritime security, especially the ISPS Code, have already been international practices and even customary international law, it is necessary for Taiwan to consider the ways to include those regulations into its domestic law and practice them, even though Taiwan is not a member of the IMO.
This thesis is going to analyze the development of the concept of maritime security and the meaning of terrorism first. Secondly, the author shall discuss the contents and practices of the ISPS Code. Thirdly, the author concludes with recommending on the ways to promote Taiwan’s maritime security capacity.
