碩士 / 國立臺灣海洋大學 / 海洋法律研究所 / 95 / Summary
Territories with borders on the East China Sea (clockwise from north) include: South Korea, Japan, Taiwan, and PRC . According PRC and Japan’s research, the East China Sea is rich in oil and gas. So, each of coastal States want it under his right. Besides, oil and gas are fluid, the “argument tabled, develop together” declaration of PRC is certainly not identified with the “middle line in the East Sea” principle of Japan. So, both of them can’t get the same idea. As Taiwan is one of the East China Sea’s coastal states, “Ocean Nationalism” is the final goal of our ocean policy. Thus, for the reason of “Law of Exclusive Economic Zone and Continental Shelf of Republic of China” has been enforced, and the East Sea was surrounded by PRC, Japan and Taiwan, we should have no reason to give up the rights in the East China Sea.
In this program, I started in the East China Sea’s location. Then, tries to analyze the legal principles of the continental shelf by examining the regulations and practices of International Law. Otherwise, international dispute settlement and Joint Development are also the points of the program. I hope that can help those coastal states to find a solution to the dispute.
Keywords:the East China Sea, Continental shelf, Delimitation, Joint Development.
