A Study on the ROC’s Prevention to Piracy : A view from International Law / 由國際法論我國對海盜犯罪行為之防制

Due to the prosperous development of sea transportation, and the progress of marine exploration as well as navigational technologies, the exploitation of sea by every country has become more and more common. However, there also have been a lot more of maritime crimes committed. Among them, piratical acts threaten the maritime order and navigational safety tremendously. Because ships usually navigate across several countries and continents in the wide open sea, piratical acts are not limited to national or regional boundaries. They are usually internationally organized. Therefore, it takes an effective and equal collective security mechanism internationally or regionally to curb or crack down the acts.

In this thesis, history of piratical acts was described at first. Then, how international law had regulated piratical acts at different times was discussed. The relationship between piratical acts regulated by the international law and the crime involved which was regulated by domestic laws was also analyzed. Suggestions were provided for future legislation of domestic laws to meet the developing trend of international law. Furthermore, the data concerning the current trends, methods of piracy, and types of piratical acts has been assimilated by collecting information about assaults by armed pirates near Taiwan and abroad, investigating related crimes planned in territorial and high seas, and discussing major cases of killing and robbery by armed pirates. In the thesis, methods and strategies used against piratical acts internationally in recent years were also discussed to offer suggestions on how to prevent piratical assault. In the end, the possibility of signing maritime agreements on mutual legal assistance in criminal matters between different countries and their concrete contents were discussed. This way, legal maritime order can be maintained in order to advance the development of sea transportation and economics internationally.
