A Study on Relevant Problems of the Taiwan’s Salvage Contract / 我國海難救助契約相關問題之研究

Taiwan Straits and Taiwan Ports are located in an important navigation waterway in western Pacific Ocean. Numerous ships navigate through Taiwan Strait and enter into or leave Taiwan ports every year. According to Ministry of Transportation and Communications, there are 313 marine disasters occurred in Taiwan’s territorial waters during 2005. These disasters caused 152 persons dead or injured, 146 ships damaged, and 68 ships sunk. Also, in view of rapid economic development in Far East Asia, there will be increasing ships appearing near Taiwan territorial waters. It is therefore necessary to explore the relevant problems concerning marine salvage systems in Taiwan area, including the nature of marine disasters, marine salvage operation, organization, as well as marine salvage contract. This thesis focuses its efforts on marine salvage contracts, which are used either in international waters or in Taiwan territorial waters. Firstly, this thesis explores the nature and contents of Lloyd’s Open Form (LOF) salvage contract. Secondly, it discusses the context of the ROC Navy salvage contract, in order to provide suggestions for revising that contract to cope with the need of modern marine salvage operations. This thesis also discusses relevant rules and regulations provided by the Salvage Convention 1989 and Taiwan’s national laws, such as Maritime Law in order to analyze the legal terms provided by the above salvage contracts. This thesis proposes some workable solution to our government and private salvage companies while improving their operations.
