Tramp shipping industry has grown rapidly in recent years, especially as from 2003. It has attracted a lot of investors to invest in this industry. Also, in consideration of high amount of capital investment in ships, the daily running costs of each ship are very high. Every ship owners or ship operators have endeavored their efforts to control ship operational costs. One of the control measures available for the ship owners or operators is to fix a reasonable laytime and demurrage rate through charter party terms. However, the calculation of laytime and demurrage charges often raises disputes between ship owners and charterers. It is necessary to explore the nature of laytime and demurrage, as well as those rules for the calculation. This thesis analyzes the established rules and regulations concerning laytime calculation and demurrage charges. It aims to explore the meaning of those rules which are used in shipping practices, including “Charter Party Laytime Definition 1980”, and “Voyage Charter Party Laytime Interpretation Rules 1993”. This thesis also uses the above mentioned Rules to discuss those disputes occurred in shipping circles concerning laytime calculation. It aims to provide useful reference both to ship owners and charterers, while entering into a charter party and solving the disputes arising from laytime and demurrage calculation.
