A study of the marine fishery management and enforcement of regulations in Taiwan / 臺灣海洋漁業管理及執行問題之探討

碩士 / 國立臺灣海洋大學 / 應用經濟研究所 / 95 / Since the Code of Conduct for Responsible Fisheries was adopted by the FAO Conference 1995, there have been several major changes in the world marine fishery. On the one hand, evidences show that more marine fishery resources have been depleted. On the other hand, effective marine fishery resource management measures have been adopted by the countries around the world gradually. In recent years, many developed countries, such as the United States, Canada and Japan, have revised their domestic fishery regulations in keeping with the modern spirit of fishery management.
The fishery authority in Taiwan has continuously reviewed and studied the Fisheries Act since its major revision in 1991. It made a significant decision in 2005 with a plan to divide the existing Fishery Act into three separate acts, one regarding marine fishery, a second for aquaculture and a third for fishing vessel crews. The scope of this thesis is limited to studying regulations in Taiwan’s marine fishery. We study the management measures in marine capture fishery and operations by the fishery authority in enforcing the regulations with an aim to find better solutions to achieve the goal of sustainable fishery in Taiwan.
In view of the fact that the central government is determined to look into fishery regulations for appropriate modifications, this thesis focuses on various important related issues that need to be examined. These include making the fishery regulations clearer and more definitive, the concept of user pay in managing common property resources, establishing disciplinary action mechanism for fishery administration, enforcing the penalty for violations, internationalization of the fishery management, making appropriate compensation for the losses incurred in fishery operation and urged the authorities adopted these measures related.
