A study of carrier's liability for carriage of passengers in Taiwan / 我國海上旅客運送人責任之研究-以雅典公約為比較基礎

碩士 / 開南大學 / 物流與航運管理學系 / 96 / There are only thirteen articles in Maritime Code of Taiwan in relative to carriage of passengers. Some Articles even refer the liability of carriage of passengers to liability of carriage of goods. Maritime Code is not reasonable, either that out of ruling of International conventions or is out of date as most articles remain the regulation instituted in 1929. Government is promoting the “Blue Highway” which is to encourage boating sightseeing surrounding Taiwan island, therefore, the re-institution of carrier’s liability in the law concerned is important.
“Athens Convention” is the international convention relating to the Carriage of Passengers and their Luggage by sea, most countries have referred to into their domestic law. Athens Convention, 1974 is most maritime code based on. This paper mainly deals the comparison of our regulations concerned and the Athens Conventions.
