碩士 / 國立中興大學 / 國際政治研究所 / 96 / Owing to increasing salary of fishing boat workers and reduction of profits in fishery in inshore fishing in Taiwan, fishing boat companies started introducing cheap fishing boat workers from China. With high profits of manpower dispatch of workers from China, there are a lot of Chinese fishing boat workers in northern Taiwan including Suao and southern Taiwan, Pintung. Due to low salary from Taiwanese employers, a lot of Chinese fishing boat workers flee to mainland China to work part time and disclose our government secrets. It is impossible to prevent from such cases.
This paper focuses on two dimensions. The first one is to correct the leakage of control of arrival and departure of Chinese fishing boat worker in consideration of national security. The other one is analysis of legal standard to find solutions to problems of Chinese fishing boat workers and practical management. The problem of the former is one can not possibly stop those who determine to smuggle people or goods into Taiwan, no matter how strict the laws are. The problem of the latter is, to boost sea economy, our government introduced Chinese fishing boat workers in the principle of no arrival but only transit. We see conflicts between standard and reality. Many Chinese fishing boat workers hold fake certificates to work for Taiwanese employers. Our competent authority is unable to examine the identity of these workers, causing to failure of due management. Problems of Chinese fishing boat workers working in Taiwan have to be discovered to maintain our national security and synergy of employment and management of fishing boat owners.
The paper also collects cases of crimes by Chinese fishing boat workers and Taiwanese ones uncovered by coast guard institutes for reference. Preventive measures are also proposed on channels of introducing Chinese fishing boat workers, wetter Permission and Management Regulation on Employment and Settlement of Chinese Fishing Boat Workers by Taiwanese Fishing Boat Owners meets needs of Taiwanese fishing boat owners and whether illegal agencies shall be legalized to be reference for authorities in making the policies and implementation. Based on the findings in this research and discussion on earlier document and theories, the research offers suggestions for practice and future feasibility.
