A study of Freight Forwarder Liability Insurance / 海運承攬運送人責任保險之研究

For the past twenty years, the maritime industry in Taiwan has been developing under a rapid pace. Ocean Freight Forwarders can now take on an extremely flexible role. Other than being an intermediary between ocean carriers and shippers, Ocean Freight Forwarders in Taiwan are also able to provide integrated total logistic solutions to optimize the supply chain management thus offering a wider and more diversified range of services than what a traditional carrier can provide. Yet together with this expanded service scope, Ocean Freight Forwarders are also facing increasingly degrees of legal liability since intermodal transport are exposed to higher risks that are difficult to forecast. Liability arising from marine transportation has therefore become a main area of concern in the Taiwan Ocean Freight Forwardering industry. One of the fundamental issues faced by the local industry is that of minimum of NT$3 million as security fund required to be lodged with the government authorities at the time to establish. In practice, this amount is never sufficient to cover giant damages arising from legal liability that could occur from the transportation of goods. Thus it becomes very important for Ocean freight forwarders to seek liability insurance in order to cover their potential operating risks.
This thesis seeks to discuss the interplay between legal liability and insurance coverage in relation to the Ocean freight forwarder. It will first identify the legal position of the Ocean freight forwarder and the various types of liability involved by reviewing the regulations of the regulatory authorities and the common practices of commerce insurance. After this, we will proceed to discuss the topic of liability insurance by looking at its fundamental definition, coverage, features, claims, as well as the basic concepts of insurance. Finally we will review the Ocean freight forwarder’s liability insurance in Taiwan and compare the clauses defined by “Commercial Insurance” and “Through Transport Mutual Insurance Association Limited”.
This thesis find that the Ocean freight forwarder’s liability insurance is distinct from carrier and Ocean freight forwarder concept , therefore, the assured should pay extra attention on this to ensure that all potential risks can be transferred. Since the current insurance practice is on claims-made basis, our suggestion is for the Ocean freight forwarder to request for an extended notice period. We also recommend Ocean freight forwarders to increase their insurance coverage for the potential risk could be properly covered.
