碩士 / 國立臺灣海洋大學 / 商船學系所 / 97 / Since 1970, the owners protect and indemnity association undertook the inter-club NYPE agreement to avoid the dispute of the cargo claim between the Owners and the Charterers. It seems more easy to solve the cargo claim, but during these years, in the practice, we found that there were many problems even the inter-club NYPE agreement was incorporated into the charter party.
The focus on this master thesis is to familiarize the reader with The Inter-Club Agreement and to present some of the problems with its application that have occurred in practice and how it be solved through case law.
The first part (Chapter 2) of the thesis presents the Inter-Club Agreement to reader and explains why it was created in the first place. The reader will get a view of the comparison between 1984 and 1996 forms. Also, the thesis will present the purpose of the Inter-Club agreement in the end of this chapter.
The second part (Chapter 3) of the master thsis presents certain aspects on some of the problem with the conditions precedent to the application of the Inter-Club Agreement. The problems when the Inter-Club Agreement is incorporated into the NYPE time charterparty will be presented to the reader.
The third part (Charter 4) of the master thsis presents the flow chart to determine the case could be applied the Inter-Club Agreement.
Finally, the master thesis presents some suggestions and opinions to reader for your reference.
