The Study of the Risk of the Charter Party: The Case of the Time Charter Party / 租傭船契約風險之研究-以論時傭船契約為例

碩士 / 長榮大學 / 航運管理學系碩士班 / 98 / The purpose of this thesis is to identify the risk of both shipowner and charterer on the contract of the time charter, and apply the FAHP model to measure the weight of these risks.
At first, according to historical literatures and expert’s opinions, the risk hierarchical structures of both shipowner and chaterer were constructed. In part of the shipowner, this thesis identified five factors and twenty-one criteria; In part of charterer, identified four factors and sixteen criteria.
Secondly, this thesis applies the FAHP model to measure the weight of these risks through the survey of the experts’ questionnaires. From this model, this thesis found out there are five important risks for each shipowner and charterer:
1.The risk of shipowner on the contract of the time charter, on the whole, “the off-hire which is caused by shipowner or ship lead to the interruption of operation of the ship” is the most importance risk. Followed by “the speed and fuel consumption of the ship can’t meet the requirement of the contract, so, the shipowner is reduced the rent and compensate for additional fuel costs”, “the ship’s hold are not passed by the port authority, lead to the attribution of responsibility between shipowner and charterer disputes arise”, “the ship status can’t meet the requirement of the port authority, so, the ship is detained by the port authority”, “released cargo without original bills of lading”.
2.The risk of charterer on the contract of the time charter, on the whole, “the off-hire which is caused by shipowner or ship lead to the interruption of operation of the ship” is also the most importance risk. Followed by “cargo damaged”, “shipowner is not ready for delivery deliberately at the final date of delivery because of the rising prices”, “crew quality is poor”, “the ship status is not inconsistent with the contractual description of the ship status”.
Finally, according to above mentioned ten risks to propose the risk management strategies. The result of this thesis can contribute strategic references to shipping industry.
