碩士 / 國立中興大學 / 國際政治研究所 / 98 / To look back the confrontation in the military, politics between Cross-Strait Relations for 60 years, People''s Republic of China(PRC) never give up the possibility of military action against Taiwan. Meanwhile,suppresses our living space in every international occasions. Due to the withdraws from the United Nations,our International status had been replace by PRC, Under China''s involvement our international standing and activity become more variable. IN International Civil Aviation Organization(ICAO)’s defination Air Transport Agreement is a political mechanism exclusively controlled by sovereign states with its negotiation, establishment ,but we can only sign the Agreement with those Country who admit our National sovereignty so the negotiations of international navigation rights also receive this condition to limit and to affect. On 13Jun 2008, SEF(Straits Exchange Foundation) Chairman Chiang Pin-kung and the head of ARATS(Association for Relations Across the Taiwan Straits), Chen Yunlin signed Cross-Strait charter flights neogitation memorandum, The agreement relating to direct passenger flights and Bilateral relation entered the peaceful coexistence step What change can International situation and Bilateral Leader made? How’s our development of traffic agreement in the period of confrontation? How many chang of scope and govern to Strait’s median line before and after Cross-strait flight? This article is intending to analyze the problems which touch International Law domain,and find out the keypoint and the way to achieve Direct flights by historical data, ICAO related documents and discussion course.
This article will survey from different dimension of the evolution between cross-Strait relations and change of our country’s international standing which effect our Traffic Right and confrontation at the middle of Strait by the change of relation between China、Taiwan and America and research of International Air Law and Regulation, after withdrawing from the United Nations and the related International organization how can we achieve the Navigation rights with the country with diplomatic relation and non-diplomatic relation and give the appropriate elaboration and the analysis, from different step of the development of Cross-Strait relations, confer variation of our navigation rights and Air Power of Strait’s median line and Bilateral relation become more and more peaceful, and about how to determine the illegal traverse median and the issue about the change that direct flights can make.
