A Study on the Legal System and Practices of Taiwan's Salvage / 我國海域海難救助法制規範與實踐程序之研究

Taiwan as a typical island country and located in the hub of shipping, together with the fishing vessels emerging from the Mainland China and Hong Kong, the numbers of ships navigating within its waters grow tremendously in numbers. And all these factors lead to the potentially growing danger, such as collisions, stranded and other shipwreck.
Due to the technological sophistication of modern shipbuilding, ships tend to be very large at size nowadays. Therefore, the casualties, property loss and environmental pollution can be incredibly serious in case of any shipwreck events. The International Maritime Organization (IMO) conducts and amends the relevant salvage conventions with the evolution of current situations for the member states or state parties to comply with, so as to improve the whole salvage system and then the loss in shipwreck events can be reduced. Although Taiwan is not yet a member state of IMO, the relevant laws in Taiwan are nevertheless conducted according to IMO conventions owing to humanitarianism and mutual assistance as well as the protection of maritime safety.
In this paper, the salvage system of the United States and Japan are to be introduced, researched and analyzed; hopefully the development and experience of their salvage system within this paper can somehow provide the authorities concerned with the information and ideas for reference, especially about the improvement of the savage organization and equipment.
