碩士 / 逢甲大學 / 公共政策所 / 99 / As fast economic development is going on today, domestic labors have very low willingness to work in a ship, which leads to more and more serious labor shortage issue in the fishery industry. Hence, to supplement the labor insufficiency in labor industry, starting from 1993, under the premise not to open up the working chance of Mainland China’s nationals in Taiwan, the policy of “employment out of Taiwan’s territory, operation out of Taiwan’s territory and temporary settlement for transit” was implemented, in other words, it is allowed the inshore ships to hire Mainland China’s crewmen to assist the fishery operation out of Taiwan’s territory; as unofficial crewmen labor cooperation across the Taiwan Strait has been carried out for about 17 years, in the past, due to the relation across Taiwan Strait, official employment system cannot be set up between both sides, hence, the right between the employer and crewmen cannot be effectively guaranteed, which brought great trouble to people on both sides across Taiwan Strait; through the inspection of the settlement situation of Mainland China’s crewmen in Taiwan, this research has proposed suggestion that meets the real situation, and it is hoped that the result can be used as a new thinking direction and reference for future law making for the supervisory government organization, seashore patrol organization, local fishery association, employer of a fishery ship in handling Mainland China’s crewmen settlement issue.
