A Research of International Community's Policy to Suprress Somali Pirates - What Taiwan Should Do / 國際間制止索馬利亞海盜政策之研究兼論我國應有之作為

碩士 / 國立成功大學 / 海洋科技與事務研究所 / 99 / Piracy and armed robbery against ship in West Indian Ocean and Gulf of Aden became the major issues on maritime affairs these years, the case originated since Somalia Central Government collapsed in 1991, the domestic situation turn into anarchy. By the functions of the government was totally out of working, long time civil war, hardship environment for living, famine because of drought, IUU fishing and the geographical position make the piracy existence and getting worse. This study referred to the cause of Somali Piracy and estimate International`s currently act against the Somalia Piracy what is right and what can be improved? What should Taiwan do as an International member will also discuss in the end.
After observing all reasons that cause of Somali Piracy, the point is after Somalia became a failed state, it can`t perform the basic functions of governance, made Somalia could not exercise rights and duties from international law. Trying to governance and keep the basic functions of a government, the United Nations has intervened in Somalia for maintaining the regional security situation and the human rights. The ways we suppressing Piracy off Somali Coast can divided into two aspects: humanitarian aids, capacities building and promote reconciliation to Somali factions can be the first aspect; the second is combating Somalia Piracy in accordance with legitimacy, the United Nations Conventions on the Law of the Sea provides a definition for piracy and international subjects should take this definition as criterion against the pirates, legal documents like United Nations Security Council Resolution can assist the legal framework too. The author also trying to find out the political factors that push States deployment of navy by naval policy theory and analysis the naval forces sent to counter piracy. This study conclude that: (1) the humanitarian aids is still limited, it can`t help all the refugees in Somalia(especially the piracy rampant areas);(2) The Peace Process is not the solution for Somali`s secession;(3) States who wants to prosecute pirates should update their domestic pirate code;(4) States should collaborate in naval operations, sharing intelligence each other, deploy lighter warships and take new tactics to deter and reduce the threat posed by pirates;(5) Finally, Taiwan should not keep silence at this issue, we need some actions under permissible abilities and budgets, as an opportunity to cooperate with international communities.
Facing challenges from piracy off the Somalia Coast, international communities should realize piracy won`t be ended in short term. It should take actions under both two aspects that the author mentioned at the beginning, to erase the causes of piracy and improve the counter piracy strategy. International communities must protect the interests of all subjects while countering Somali piracy.
