This study mainly focuses on cars equipped with navigation system which divides into products of vehicle and service of map information and then discusses whether it could apply Products Liability and Service Liability of Consumer Protection Law to protect consumers and users in Taiwan. Simultaneously requires the business operators who massively produce the cars and navigation system should strictly control which they sell in the market. Finally, this study tries to figure out that whether the cars and navigation system could be applicable to Products Liability and Service Liability of Consumer Protection Law in our nation by analyzing foreign laws and related case studies.
A navigation system provides not only position, but guidance path to arrive destination. But some product defects such as update the map inaccurately or the incorrect locating information on navigation system may cause damages on consumers’ life, health or property. The legal issues are the followings discussed. What is the definition of service? Is service applicable to service liability in Consumer Protection Law? In addition, consumers may suffer damages by the automotive goods emerging defects, such as the automobile explodes flushes, airbags without burst, brake system failure.
This research will first introduce the concepts of navigation cars, including its evolution, function, and types. Second, it refers to the differences between cars defects and navigation system defects on Consumer Protection Law. As consumers faced to the traditional civil claims, they will hard to prove the defect on car navigation system with the lack of professional technology. How to allocate the burden of proof is another problem. Above all, this study will figure the above-mentioned disputes through Consumer Protection Law, relevant case study, and practical opinions in Taiwan and further compare with other countries’ regulation.
