The volume of global trade has greatly reduced, and the demand of shipping transportation services has obviously declined thereafter. Many shipping companies select to cancel shipbuilding orders or adopt strategies of late delivery of ships, in order to reduce the risks of operation. However, this will not only result in buyers some liabilities arising from the breach of the contracts, but also result in builders certain impact.
This thesis takes the Shipbuilding Association of Japan (SAJ) contract as a model to analyze the risks arising from breach of shipbuilding contracts. First, it analyzes and discusses the contents and legal nature of shipbuilding contracts, and briefly describes the ideas and processes of risks management and the risks of international project contracts. Then, it analyzes, discusses and recognizes the risk arising from breach of shipbuilding contracts in the three parts of builders‟ defaults, delivery, and buyers‟ default. It aims to provide reference for builders and buyers to recognize the legal risks arising from shipbuilding contracts.
