碩士 / 逢甲大學 / 財經法律研究所 / 100 / Abandonment is one of the unique rules in marine insurance laws. Taiwan’s Maritime Law has grossly classified this rule into the abandonment of the ship, cargo and freight. References regarding “Abandonment” in Taiwan are very limited and out-of-dated, and the main materials for reference in this study are Taiwan’s Maritime Law and selected judgments in Taiwan as well as the1906 Marine Insurance Act in the United Kingdom. This study is aimed to link and compare regulations of Maritime Abandonment between Taiwan and the United Kingdom to investigate the different types, elements, classifications, the loss, and extinguishes of Martine Abandonment. Based on this study, revision of the abandonment rule in Taiwan’s maritime law is suggested to accord with current international conventions and fit global requirements.
