Taiwan, which is an island country, possesses rare natural resources and has a high percentage on degree of dependence upon foreign trade. The overall development of the country and the promotion on the national power both depend on the exchanges with other countries and successful trade. Owing to the unfavorable situation and less connection with the international organizations, our country is subjected to the adverse affection on overall development. For more benefits of our country, actively concerning the international trends and positively participating in the international organization are the imperatives for the government. After the 911 event, all countries face the dilemma of the trade security or the customs clearance.
As one of the front-line administrations at the border of country, the Customs is threatened with “non-traditional security”, such as transnational organized crime, drug trafficking, illegal immigration, infectious diseases, terrorism, network security and so on. In order to effectively enforce the law at the border, Taiwan Customs should accelerate the adjustment in the investigation strategies and mechanisms. The government ought to ascertain the leading administration in the border investigation, and integrate the related border affairs organizations and grant Customs the judicial powers which involve judicial police powers and the criminal investigation powers. For the administrant efficiency and avoiding the pointless interference from other organizations, the Customs should directly bring the crime to justice after finding out the criminal evidence.
In addition to ensuring the tariff revenue and preventing the smuggling and illegal act, Customs tasks would provide a high quality, rapid and efficient, fair and transparent clearance environment to reduce the time and cost of clearance for enhancing the business competitiveness furthermore. However, with the rapid growth of the global economy trade and diversification of social demand, the people and business strongly request for better service quality like fast and convenient clearance at the less cost. Customs also implement the agreement with other countries and controls at our border to avoid all sorts of dangerous goods and activities entered besides levying and anti-smuggling activities. These matters include endangering the country security, national health, environment protecting and infringing the intellectual property. Therefore, how to deal with the complex affairs, take clearance facilitation and the enforcement of the law into consideration both depend on rare manpower is the goal that Customs should achieve.
Today, because of facing numerous entering /exiting passengers and cargo, Customs should adjust the scope of investigation mechanism strategies to effectively implement the border controls. The scope of strategies include the adjustment of investigation, reinforcement on risks management, the use of equipment and appliances, detector dogs training, intelligence sharing, international cooperation and for a specific affairs within the scope of the judicial police rights. Furthermore, this study is aimed at not only reviewing but making recommendations on related issues. Hopefully, these suggestions would be helpful to accelerate the clearance of goods and improve the performance of the investigation.
