碩士 / 國立成功大學 / 法律學系 / 100 / With unique geographical advantage, Taiwan has developed multiple ocean multiculturalism, covering history, literature, art, and religion and fishery development. The oceans provide us fertile fishery resources, which support the development of fisheries, including capture fishery, ocean fishery, aquaculture and recreational fishery. However, in recent years, Taiwan's fishery resources are increasingly damaged due to the human behavior and environmental changes. For sustainable development of fisheries, we should prevent the depletion of fishery resources; strengthen the maintenance and reasonable control of aquatic harvest. We concern about whether the managements and constraints of the existing administrative legal system can diminish the destruction of fishery resources and strengthen the development of fisheries environment. In this study, we focused on the aquaculture, capture fishery, recreational fishery and ocean fishery and explore their administrative control behavior and the status of international law, respectively. In the aquaculture, the major problems are water usage, the control of GMO (genetically modified organism) and the treatment of fish diseases and drug residue, we should direct to offer chief government organization competent authority, isolate GMO, control biological reproduction and establish the SOP of drug therapy and examination. For capture fishery, we should implement the administrative control of overfishing and by catch. In recreational fishery, we can strengthen the authority integration and drawing schemes of business scope against the imputes on authority integration of commercial fishing boats and pleasure vessels, boat seats, license issue, restrictions of aquatic harvest and reestablishment of fishing vessel. In ocean fishery, we need to execute legal system norms and universal education of marine conservation and sustainable management. For the sustainable fisheries development of Taiwan, we suggest these effective administrative controls to preserve the fishery resources and clarify the work directions of our regional fisheries management organizations.
