碩士 / 國防大學管理學院 / 法律學系 / 100 / This thesis is mainly concentrated on the study of civil liability and indemnity for marine oil pollution damage caused by vessels. Chapter one is a brief introduction about overview of this thesis. For references of criteria of related legal issues, chapter two mainly would introduce relevant international conventions relating to marine oil pollution issues, including 1976LLMC, 1996Protocol, 1969CLC, 1976Protocol,1992Protocol, 2000Amendments, 1971Found, 1976Protocol, 1992Protocol, 2000Amendments, 2003Protocol, 2001Bunker and 2007 The Nairobi International Convention on the Removal of Wrecks. Then chapter three would discuss mainly legal issues involving marine oil pollution damage caused by vessels from the perspective of applicable laws in Taiwan such as Civil Code, Maritime Act and Marine Pollution Control Act and take a comparison with international conventions in order to make some suggestions for legal amendments in the future. In chapter four, there are some case studies not only covering warship’s status on marine oil pollution but also marine oil pollution from common ships, as Exxon Valdez, Amorgos, and other cases recently. In final chapter, the article would try to propose the revisions of our country’s law to make it compatible to international modern trends.
