A Study of Legal Regime of Yacht in Taiwan / 我國遊艇管理法制之研究

碩士 / 國立臺灣海洋大學 / 海洋法律研究所 / 100 / Taiwan is an island country, and the surrounding environment is suitable for the de-velopment of maritime tourism and leisure businesses. However, in view of the im-pact of martial law and the thinking of the past that “paying attention to land and underrating the sea”, government took a more highly regulated measures for access-ing to the coast, and the public also had the hesitation about taking sea activities. In recent years, due to the economic development, the national income and the stand-ard of living had improved; the domestic leisure and the entertainment conscious-ness of the people also had relatively increasing, so that the people gradually pay at-tention to the marine leisure activities. Nevertheless, Taiwan has long but no regula-tions for the development and management of yacht activities can be followed, and the environment of yachting is not perfect, so that the effect of activity promoting is poor. The revision of Ship’s Law was promulgated on November 12, 2010 by the Leg-islative Yuan. The most important part of the law is that having a clear definition of yacht, deregulation of the inspections and measurements, and to put the matters of registration and licensing into Ship’s law. Since the amendment of Ship’s law, it is still worthy of further investigation that whether the relevant regulations of yacht meet all requirements. This study is to seek the real issue of the development and man-agement of yacht activities through the literature discussion. It takes the relevant regulations of the advanced countries as an indicator, like Singapore, New Zealand, Australia and the United States, analyzes the differences of yacht management and makes recommendations. I hope that it can provide a reference for the policy ad-justment and the specification revision of Taiwanese regime of yacht, and for the promotion and the sustainable operation.
