Bulk shipping freight charges are classified as voyage charter (Ocean Freight) and time charter (Charter Hire) by the type of business operation. Operators, regardless of proprietary ship or chartered ship, often face dispute over freight charges.
The historical literature almost all dwells on the study of the single charter party or demurrage and dispatch instead of on the clauses regarding voyage charter freight and time charter hire. The main purpose of this paper is to discuss the “clauses issue” and “responsive measure” related to the freight charges of the bulk shipping from the charterer’s viewpoint.
When operating the bulk shipping, people have to bear the carried cargo’s responsibility in accordance with Maritime Law. Voyage charter is one kind of transportation contract, the center between ship owner and charterer is cargo, charterer has to pay the ocean freight regularly for ship owner. However, the purpose of time charter is vessel’s operating profit, charterer has to pay the agreed charter hire regularly. The research analyze three kinds of voyage charter parties which are GENCON 1994, NIPPONVOY 1963 and voyage charter party confirmation of CCOIC (China Chamber of International Commerce) about the description of ocean freight payment terms, also three kinds of time charter parties which are NYPE93, BALTIME 1939 and time charter party of Japan Shipping Exchange about the description of charter hire payment terms. According to the research, the frequent clauses issues of ocean freight &; charter hire are caused by lack of the knowledge about clauses details or both parties have different understanding about the phrases as well as the clauses on the contract. It’s easy to have arguments while drawing up the contract or performing period.
Wishing the relative dealer will get deeper understanding about the clauses issues of ocean freight and charter hire payment from this research result.
