碩士 / 國立臺灣海洋大學 / 航運管理學系 / 101 / This study aims to compare and analyze the applicability of ship’s property rights between the ROC maritime law and relevant international conventions. The ROC maritime law specifies four kinds of ship’s property rights. There are ownership, ship mortgage, maritime lien, and possessory lien on ship. It explores and discusses relevant issuing relating to ship’s property rights. Firstly, this study discusses the concept of ship’s property rights and elucidates its nature, characteristics and scope of application of different ship’s property rights. It also deals with potential issues of ship mortgage and ownership of ship, and compares relevant international conventions. This study analyzes the problems of maritime lien and possessory lien on ship, and then point out relevant provisions stipulated in various international conventions. Due to the importance of ship’s property rights in the ROC maritime law, this study intends to discuss those important issues concerning the application of property right on ship under the ROC law and provide reference for future modification of relevant provision of the ROC maritime law.
