碩士 / 世新大學 / 觀光學研究所(含碩專班) / 101 / By using the BOT (Build-Operate-Transfer) project to build up the public construction provide functions in terms of increase employment opportunities, promote private investment, improve services efficiency, speed up to build the public infrastructure etc, therefore BOT being adopted extensively among all other countries. In Taiwan, there were about 71 cases using BOT method to build up the visitor accommodation facilities, all these hotels or resorts built up under the nominal of public construction.
This research is using current researches literatures to manage and wishing able to show the fundamental conception of BOT and its utilization principal, further to study the relevant theories related to justice, and to understand the essential of procedural justice and distributive justice, to monitor and check the current approved BOT cases on hotels facilities. At the same time, by deeply interview terminology towards relevant officer whom handled the cases, community organization and entrepreneur, to understand each party if they recognize the management of the hotels facilities BOT project and thus to find out the similarities and differences between all these parties.
In order to lead the BOT system and its application become more as complete as possible, this researches and study make a careful selection the samples cases that meet the below-mentioned five conditions; the target investments is under public interested nature、 subject to the requirement that land usage zoning with BOT project category、 government should play a role as supervisor and manager、the public construction with the main purpose that it will be used by majority population、 fully explore to the public regarding the details of construction operation agreement and its actual situation of all the commitment matters. The analyst and facts of the researches not only become future references of hotels facilities BOT project, it also might release the doubts by build up the prober BOT system. The study expects to increase the truth from society for the BOT construction, thus reduce the resistance and continue the BOT system to operation and execute well in the future.
