A Spatial Analysis of Using Geographic Information System to Execution Penalty on Fishing Boats from Mainland China for Entering the Territorial Waters of Taiwan- Cases in the Waters in Central Taiwan / 應用地理資訊系統於執行大陸漁船越界捕魚裁處罰鍰之空間分析-以臺灣中部海域為例

碩士 / 聖約翰科技大學 / 自動化及機電整合研究所 / 101 / The additional provision 80-1 in the Constitution of the Republic of China to Regulations Governing the Relations between the People of the Taiwan and the People of the Mainland China which is aimed to increase the penalty for violation of the first provision in the Ordinance 32 in the Constitution of the Republic of China to Regulations Governing the Relations between the People of the Taiwan and the People of the Mainland China has been implemented by the Coast Guard Administration since March 21st, 2012. Moreover, it is one of the administrative sanctions to ban against cross-border fishing and illegal entry into waters belonging to Taiwan. Take the waters of central Taiwan as an example, the 65 cases of cross-border fishing in 2012 has decreased by 68% compared with the 175 ones in 2011. It showed that the implementation of increasing penalty did take the effect since it was implemened on March 21st, 2012.
In this study, we applied the geographic information system (Geographic Information System) to analyze the distribution of the cases of seized cross-border fishing vessels from 2011 to 2012 and simulated the sea area. We further clarified the relation between seized cases and their spatial distribution by digital mapping analyzer. We studied the relationship among the co-localization of cross-border fishing vessels, the seized cases and peripheral fishery resources in analysis of co-localization. In addition, we further investigated how the invading sea area varied after the implementation to ban against cross-border fishing of the mainland China vessels. This study could therefore provide a quantitative basis for both the legislative and the related administrative organizations as a measure of legislation and implementation of the law regarding the cross-border fishing issue.
