Over exploitation and bad environment of survive cause the huge reduction of amount, fast disappearance of biological diversity in the ocean and exhausted fisheries resource. People are facing the big danger of ocean resources in sustainable development. If we don’t take any working step, people can’t survive and the situation will be getting worst as marine ecosystem couldn’t be recovered, food, natural damage and disease would increase the speed. Therefore, scientists suggest the government can take emerge action. With the ecosystem as the foundation, rebuild fisheries management, prevention f marine pollution, recovery of land and rebuild marine ecological preservation area in order to save the health of marine ecosystem. Nowadays, many countries compete to set big and numerous marine protected areas. No doubt, effective management is the way to success, so set and integrated relative law is the only method to ensure people can bring the effectively of management in protected area.
In our country, the relative regulations in marine protected area are separated in different law; therefore, it’s hard to integrated all about the goal, range, punishment…etc. It’s also easy to shift responsibility onto others in every department of government. It’s not good if the big number of marine protected areas. As people ignore the original goal of setting them, statistical data will make supervisor get lost and satisfied in surface without the effectively. It must a good way if people can make the integration and totally protection. Even the fish men cannot to accept the situation; people still can set it as a subject in the future. “To do a good job, one must first sharpen one's tools.” If people can set a government organization to protect marine resource and integrated the disorder in both law and management, it will be benefit to the situation of the lack in marine resource and turn the danger into safe. This thesis is showed the meaning and the goal in marine protected area, and then finds the basic principle. At the same time, to view the deficiency and law in our country by International Convention and Customary Law with the rules and policy of other countries. Last, give concrete conclusion and suggestion by the research outcome, and think about the necessary of setting Marine Basic Law. To make sure the benefit of human kind, try to work hard to build the marine resource in sustainability.
