碩士 / 國立臺灣海洋大學 / 航運管理學系 / 102 / Ocean freight forwarders and it’s agents serves between shipper and consignee by contacting and handling of cargo transported, shipped the goods in the port of loading and port of destination is reached, the situation of goods can be quickly learned. The routing cargo is the major sources for most of ocean freight forwarders, bills of lading for the important documents of the property, because the agents release cargo without original B/L by breach of contract and tort, its problem that ocean freight forwarders have to be faced. In this study will focus on Agency agreement of obligations and responsibilities between ocean freight forwarders and it’s agents by literature review and case analysis. The main results are as follows:
1. Ocean freight forwarders industry should entrust it’s agents, the deal on behalf of the consignor links and receive goods, and issue its own bills of lading, same as carriers. Bills of lading is negotiable securities, ocean freight forwarders and it’s agents shall comply with the responsibilities and obligations of the agency agreement, the consignee when the delivery of goods should promptly release and hand bills of lading to it’s agents for the purpose of avoiding violations.
2. Because local measures of release cargo without original B/L or delivery against bank guarantee, the agents should be delivery of goods and handed over to the consignee by breach of contract and tort, ocean freight forwarders and it’s agents have to deal with the original bills of lading of shipper in executive of securities.
