Negotiating Modes of Households to be Relocated —a Case Study of Taiwanese Real Estate Company in Shanghai / 城市房屋動遷戶談判模式之研究:「以上海台商地產公司為例」

For real estate enterprises, the choice and purchase of land , the visit and negotiation with relevant government departments , and the deliberations with the relocated households all need various assistance and support by the government. In order to persuade the relocated households into moving, real estate enterprises should take a two-pronged approach ,which refers to “convince the person by sensible reasons and attract him/her by interests in the same time” on the basis of legal requirements. During this process, great patience and excellent communication skills are indispensable, that’s why the establishment of a new construction project requires a combination of intellectual and professional parties.

At present, the property market in China has been fully expanded, especially in the second and third tier cities. The competition is much tougher in Shanghai both in the market of commercial residential buildings and housing residential, and the relocation of urban housing ten years ago is incomparable with what it is today. The price of housing in China is much too expensive nowadays, which compels the government to intervene in the market of real estate,such as suppressing the real estate developers, restricting on bank lending,shrinking money supply to real estate developers,issuing orders on property-purchasing limitations,etc. As a result, the excessive exploitation makes no impressin on restraining the spiraling house price, while the limitation of property-purchasing only lead the richers to find more ways to buy property in disguise. To the real estate developers, there are always countermeasures to the government policy on one side. The endless emergence of finaning options such as shadow banking, entrusted loan and so on provide feasible ways to the collection of capital for real estate items. On the other side, the relocated households manage to seek as much money as they can. There have been many cases which the real estate developers finially reached a compromise to the households whe won’t move before their requriments are met.

The Adminstration of Demolition and Removal of Urban of the State Council, which is published by People's Republic of China in 1991 (State Council Decree No. 78 , 1991 ) has been repeatedly modified several times, thus, the house relocation has entered into a new period of time. As a result of re- zoning or the transformation of old urban areas, there will be demands of demolition and removal, and when the process of demolition begins, a proper mode of communication is quite an important skill in this game. To meet the needs of adjustments of urban area, a large push projects or a municipal reform, the government will develop the overall urban planning and land re- distribution (also known as redistricting). Regulations about demolition should adjust itself to the ever-changing society. How to match the new regulations with Constitution, Property Law, Land Management Law and many other laws , in order to maintain the fairness and justice of society ? Local governments and real estate developers are on behalf of the demolition party, while the owners of housing property represent the opposite side; both of the two parties consider more about their own interests than others during the process of game. To the units who actually perform demolition work, they need to think about a more peaceful way to solve the problem under the New Deal Demolition. It is said that "people in Shanghai make a fortune by house relocation", Well, how to solve the chaos of administrative compulsion relocation in the second and third tier cities? Whether the new regulations could supress the deterioration of demolition mode? According to the results of this research and the New Deal of "Sunshine relocation” in Shanghai, it is believed that the thesis will be helpful to improve the current demolition mode.
This study focuses on the mode of communication in demolition and hopes to find a healty way of communication and interaction between the two parties (the demolition party and the passive demolition party). This ideal mode, if it exists, could reach a settlement acceptable by both sides and be an example mode of communication in demolition market for referernce.
This study have found that, if the demolition party adopt a regulatory and humanized public announcement, communication, negotiation and consultation mode instead of the traditional compulaory way during the process of house relocation, the relocated households will comprehend and an effective results can be achieved in a short time. This method can not only solve the problems of demolition, but also control the costs and save an enormous sum of money during house relocation. This article, on the other hand, applies the methods of communication mode study, case study, SWOT analysis and Thick black negotiation mode research. The strategy of demolition advanced in this thesis could be a significant assessment index for Taiwanese businessmen working in the real estate industry of China, it is also an indispensable basis for both of the parties in demolition.
